Complaint Filed/Notice of Claim Served Before July 1, 2003:

  1. If a contract or note provides the interest rate, use that interest rate.
  2. In all other cases,

    (a) If the Judgement is $30,000 or less, pre-judgment interest is 8%.
    (b) If the Judgment is $30,000 or more, pre-judgement interest is as follows:

    3. NOTE: Prejudgment interest is not awarded on judgments in Small Claims actions unless the action is based on a contract or note that sets out a rate of interest, in which case prejudgment interest is allowed at the rate specified in the contract or note.
