Complaint Filed/Notice of Claim Served Before July 1, 2003:
- If a contract or note provides the interest rate, use that interest rate.
- In all other cases,
(a) If the Judgement is $30,000 or less, pre-judgment interest is 8%.
(b) If the Judgment is $30,000 or more, pre-judgement interest is as follows:If the complaint is filed or notice of Claim is served in the following year Then the Pre-Judgment Interest is 2003 2.41% 2002 3.28% 2001 6.34% 2000 6.95% 1999 5.63% 1998 6.55% 1997 6.50% 1996 6.21% 1995 8.21% This Chart already includes the calculation of the T-Bill rate plus 1%

NOTE: Prejudgment interest is not awarded on judgments in Small Claims actions unless the action is based on a contract or note that sets out a rate of interest, in which case prejudgment interest is allowed at the rate specified in the contract or note.
