Supreme Judicial Court invites amicus briefs on effect of unsworn notice of claim in medical malpractice proceeding

The Maine Supreme Judicial Court, sitting as the Law Court, invites briefs of amici curiae on an issue presented in Perri Frame v. Millinocket Regional Hospital et al., Law Court docket number Pen-12-322, scheduled to be argued in May 2013.  The question presented concerns whether the statute of limitations in a medical malpractice proceeding is tolled by the filing of an unsworn notice of claim.  Electronic copies of the parties’ briefs are available below.

An amicus brief may be filed by or on behalf of any individual, entity, or group of individuals and/or entities, without separate leave of the Court.  All amicus briefs must be filed on or before April 17, 2013 at 4:00 p.m., at the address listed below, and must comply with M.R. App. P. 7(c), 9(e)(1), and 9(f).  In addition to filing and serving the required number of copies, any amicus must send a copy of the brief electronically, as a single pdf file, to lawcourt.clerk@courts.maine.gov.
