Procedures Applicable to a Defendant in a Protection Case - If Defendant Seeks To Have Order Modified or Terminated
E. If Defendant Seeks To Have Order Modified or Terminated: If the defendant wants the order changed or terminated, defendant must file with the court clerk a written motion to modify or terminate. A protection order may be modified if the defendant can 23 show a substantial change in circumstances since the entry of the permanent order. The clerk will give the defendant a time and date for the hearing on the defendant's request to modify or terminate. The plaintiff must be notified as to any such motion and hearing, and has a right to be present. The clerk will arrange for service of the motion and notification of the hearing on the plaintiff. Hearing on defendant's motion to modify or terminate is governed by the same procedures set forth in IV(B), above, entitled "The Final Hearing." The plaintiff also may file a motion to modify or vacate the order, in which case the defendant is entitled to notice and may defend in a manner consistent with the procedures set forth above.
