ORDER DESIGNATING FIELD OPERATIONS SPECIALISTS AS DEPUTY CLERKS AT LARGE

Standing Order: ORDER DESIGNATING FIELD OPERATIONS SPECIALISTS AS DEPUTY CLERKS AT LARGE(PDF)

Effective August 31, 2007

WHEREAS, pursuant to 4 M.R.S. § 107, the Chief Justice of the Superior Court may, approve the permanent appointment of deputy clerks;

WHEREAS, pursuant to 4 M.R.S. § 107-A, the Chief Justice of the Superior Court may authorize any deputy clerk of the Superior Court to issue process for the arrest of persons charged with crimes if the Chief Justice of the Superior Court is satisfied that deputy clerk has the necessary training and learning to perform that function;

WHEREAS, pursuant to 4 M.R.S. § 159, the Chief Judge, the Chief Judge shall appoint clerks and deputy clerks as necessary;

WHEREAS, pursuant to 4 M.R.S. § 161, The Chief Judge of the District Court may also authorize any deputy clerk of the District Court to issue process for the arrest of persons charged with offenses if the Chief Judge is satisfied that deputy clerk has the necessary training and learning to perform that function; and

WHEREAS, the Chief Justice of the Superior Court and the Chief Judge of the District Court are satisfied that Field Operations Specialists have the necessary training and learning to perform the functions of the Clerk, including issuing process for arrest of persons charged with offenses.

NOW, THEREFORE, it is ORDERED, as follows:

Field Operations Specialists are hereby designated Deputy Clerks at large. They are authorized to undertake any duty that may be undertaken by a Deputy Clerk or that a Clerk may delegate to a deputy, including but not limited to administering oaths, issuing process for the arrest of persons charged with criminal offenses, and preparing, signing and attesting court documents, in any court clerk’s office in the state.
